Who is responsible?

What data do we process?

When you complete the contact form on this website, we process the details you provide: your first name and surname, your telephone number, your email address, and the subject and content of your question or instruction. If you contact us by email or telephone, we process the details you give us. Please do not include special categories of personal data in the contact form, such as information about your health, unless this is strictly necessary for your question.

When you visit this website, technical data needed to operate and secure the website is also processed, such as your IP address and browser type.

What do we use your data for?

We use the details from the contact form solely to answer your question, to contact you and, if you so wish, to assess whether we can accept an instruction from you. We do so on the basis of your request to take steps prior to a possible contract and on the basis of our legitimate interest in being able to deal with enquiries made through our website. We do not use your data for newsletters or marketing.

Before accepting an instruction, we as lawyers (advocaten) are required by law to carry out a conflict check and, in certain cases, to verify your identity. We may ask you for additional information for this purpose.

How long do we keep your data?

We do not keep your data for longer than necessary for the purpose for which we obtained it. If your enquiry does not lead to an instruction, we delete the details from the contact form no later than twelve months after your enquiry has been dealt with. If your enquiry does lead to an instruction, the details form part of the file and the retention periods applicable to lawyers apply.

Who do we share your data with?

We do not sell your data and do not share it with third parties, unless this is necessary to deal with your enquiry or we are required to do so by law. For hosting this website and sending email, we use service providers who process your data solely on our instructions. We have made arrangements with them on the security and confidentiality of your data. We aim to have your data processed within the European Economic Area. Where this is not the case, we ensure that appropriate safeguards are in place.

Security

We take appropriate technical and organisational measures to protect your data against loss and unlawful processing. The connection to this website is encrypted, and only staff who need your data to deal with your enquiry have access to it. As lawyers, we are also bound by a statutory duty of confidentiality.

Your rights

You have the right to access, rectify or erase your personal data. You may also object to the processing, have the processing restricted and have your data transferred. You can send a request to info@bavelaar.nl. We will respond within one month. To prevent misuse, we may ask you to identify yourself.

If you are not satisfied with the way we handle your data, we would like to hear from you. You also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).
